Commercial Manager
To establish and maintain best practice standards, policies, procedures and processes in all commercial dealings and ensure, as Commercial Manager, provides expert commercial, risk management, legal, insurance, project management and business systems advice and support to Senior Management, Operating Divisions and Projects with the objective of achieving business excellence that helps the company to be positioned as leader in the industry.
Key Accountabilities:
- To ensure that the main contracts terms and conditions of tender documents and other pre-bid agreements for prospective projects across the company are reviewed and where necessary commercial and contractual qualifications are drafted in order to ensure that the terms of offer protect and/or further safeguard the company’s interest and comply with company guidelines.
- To develop and maintain policies and procedures in order to ensure effective administration of contractual and commercial matters related to the Main Contracts, subcontracts and other suppliers of goods and services including advising on disputes, claims etc. in order to maximize the financial recovery and profits.
- To undertake reviews of project financial reports in order to ensure accurate forecasting and reporting and appropriate identification and management of risk and opportunity issues.
- To oversee the preparation, review, amendment and negotiation of terms and conditions of pre-bid agreements, joint venture agreements, main contracts, supply agreements etc in order to protect and further company interests commercially and contractually.
- To develop and implement dispute resolution processes within the company in order to resolve disputes to the advantage of the company and consistent with company’s business strategy.
- To coordinate the notification and negotiation of insurance claims across the company in order to maximize the settlement value.
Qualifications:- Degree in Commercial, Legal, and Quantity Surveying or related disciplines
- Minimum of 10 years experience
- Experience in the construction MEP industry dealing with quantity survey, contracts, risk management, insurances, disputes, claims, legal issues, financial management and all associated commercial aspects of a major construction company.
- Experience in project management and leadership jobs in the Middle East – Middle East experience is essential.
- Good stable employment history with main contractor/MEP contractor background.
