Our client, a specialist Construction and Technology law firm, is looking for a Senior Associate to join their highly reputable team. The successful candidate will be instrumental in guiding clients through the complex legal landscape of construction and engineering projects.
About:
The responsibilities associated with this role include advising on construction and engineering project structuring; drafting and negotiation of bespoke and standard-form construction contracts; advising on regulatory and contractual compliance; assisting clients in managing risk; claims drafting and management of contractual disputes; representing clients in litigation and alternative dispute resolution proceedings; and providing general advisory services.
Duties:
- Risk assessment and project structuring
- Establish client’s risk appetite, objectives and appropriate commercial risk distribution in each project
- Advise on an effective commercial structure; enquiry documentation and procedure; pricing strategy; commercial terms; and procurement strategies to achieve client’s objectives
- Draft and negotiate various contracts related to construction and engineering projects
- Standard form construction and professional services agreements such as JBCC, FIDIC, NEC and GCC contracts
- Bespoke construction and related supply and service contracts
- Risk management and compliance
- Evaluate potential legal risks associated with construction projects and advise clients on best practices to minimise exposure to disputes and liabilities
- Remain abreast of relevant laws, regulations, and industry standards to ensure client’s practices are compliant and informed by the latest legal developments
- Monitor requirements for contractual compliance and draft correspondence including claim submissions to ensure such compliance
- Litigation and dispute resolution
- Management of disputes that may arise during the construction process, including negotiating settlements; representing clients in mediation, adjudication or arbitration; and handling litigation where necessary
Key requirements:
- Admitted attorney
- 5-8 years of post-qualification experience
- Knowledge of contract law
- Workable knowledge of construction law and experience in alternative dispute resolution is an advantage
- Ability to lead the entire litigation process; briefing counsel; facilitating the institution, defending and/or settling of litigation proceedings
- Well-versed in legislative interpretation; implementation of regulations; and legal strategy development
