Compliance & Contractor Care Administrator
We are excited to announce an opportunity for a Compliance & Contractor Care Administrator to join our international Contractor and Compliance Team based in Cape Town. This role will focus on supporting Salt’s sales teams and business entities across Europe, with a particular emphasis on contractor compliance in various EU jurisdictions!
This role requires prior experience in recruitment agency compliance and contractor contracts, specifically within the context of EU contracting regulations. Knowledge of terms such as ZZPs, Freiberufler, and A1 certificates is essential for this position.
Key Responsibilities:
- Onboarding contractors in compliance with EU tax and labour laws, including setup of contractors on the pay and bill system, ensuring compliance with EU regulations like the French Portage Salarial model.
- Managing the documentation of ZZPs (self-employed contractors in the Netherlands) or Freiberufler (freelancers in Germany), ensuring all contracts and payment terms align with local tax and social security obligations.
- Issuing A1 certificates and ensuring that contractors are correctly classified under posted worker laws for cross-border assignments, as well as monitoring local social security contributions across various EU member states.
- Reviewing and managing contractor queries regarding compliance Deemed Employment, and Cross-Border VAT where applicable.
- Ensuring that all contractors are compliant with local tax regulations, including freelancer classifications, and self-employment regulations as per the EU's Posting of Workers Directive.
- Liaising with internal teams to resolve payment issues quickly, ensuring compliance with local payroll requirements, including the proper withholding tax for contractors operating under different EU tax regimes.
- Regularly updating contractor records in the CRM database, ensuring proper GDPR compliance and accurate tracking of contract terms, including right-to-work documents and visa validity for contractors working within the EU.
- Responding to third-party reference requests and ensuring contractor checks are conducted in line with EU data protection laws (GDPR).
- Supporting contract audits and managing visa and right-to-work documentation for contractors working across EU borders, ensuring full compliance with Schengen Zone and EU immigration policies.
- Tracking insurance, passport, and qualification expiry dates for contractors working on cross-border assignments under EU legislation.
We’re Looking For:
- Strong knowledge of EU employment laws and contracting models such as ZZP in the Netherlands, Freiberufler in Germany, and autónomo in Spain, including their tax and social security requirements.
- Experience supporting a European contractor desk, with a deep understanding of A1 certificates, posted worker regulations, cross-border VAT, and self-employment laws across the EU.
- Familiarity with IR35 in the UK and Deemed Employment laws that affect contractors in several European jurisdictions.
- Ability to manage complex contractor documentation, ensuring compliance with local tax, labour, and social security regulations in multiple EU countries.
- Excellent organizational skills to manage a dynamic and fast-paced work environment, with a keen eye for detail, particularly in relation to GDPR and other EU compliance standards.
- Experience with recruitment software such as Salesforce and Intime (preferable).
- Prior experience with contractor care and compliance within an international contractor recruitment environment, with specific knowledge of European tax structures, A1 certificates, and cross-border contracting.
- A self-motivated, proactive attitude and the ability to work autonomously while maintaining a high standard of compliance.
- Proven ability to track and ensure compliance with visa, passport, and work permits across various EU countries.
