Malaysian Communication and Multimedia Commission (MCMC) – Sepang, Selangor

To execute the duties of a Prosecuting Officer as authorized under section 377(b)(5) of the Criminal Procedure Code. These include perusing investigation papers, conducting cases in court, providing legal opinions, and others pertaining to offences under the Communications and Multimedia Act 1998, Postal Service Act 1991, Digital Signatures Act 1997, Strategic Trade Act 2010 and their subsidiary legislations.

Job Responsibilities

  • Conduct prosecution of cases in court for offences under the purview of MCMC.
  • Peruse investigation papers referred by the Enforcement Division and prepare recommendations to the Deputy Public Prosecutor.
  • Prepare write-ups and recommendations for high-profile investigation papers that need to be referred to the Attorney General's Chambers.
  • Prepare write-ups and recommendations for letters of representation submitted by the accused to the Deputy Public Prosecutor.
  • Give instructions to the investigating officer for case management and trial in court.
  • Prepare documentary exhibits and witness statements for trial in court.
  • Prepare reports and recommendations to the Deputy Public Prosecutor on court decisions when the case is complete.
  • Prepare reports and statistics on court proceedings for the Deputy Public Prosecutor.
  • Provide input and legal opinions on prosecution-related matters.
  • Attend meetings, engagements, and projects on prosecution-related matters.
  • Execute administrative and strategic management duties or projects assigned.

Qualification & Work Experience

  • LLB (Hons) from a reputable university.
  • Preferably admitted to the Malaysian BAR as an advocate and solicitor.
  • Minimum 5 years of working experience as a criminal litigator/prosecutor.
  • Experience in adducing or dealing with digital/electronic evidence in court.
  • Experience in telecommunications or cyber-related matters is an added advantage.
  • Good understanding and knowledge of criminal law, criminal procedure, and evidence law.
  • Good understanding and knowledge of the acts under the purview of MCMC such as the Communications and Multimedia Act 1998, Postal Service Act 1991, Digital Signatures Act 1997, Strategic Trade Act, and their subsidiary legislations.
  • Good command of English and Bahasa Malaysia, both in writing and speaking.
  • Proficient with computers and social media.
  • Able to conduct court proceedings independently.
  • Able to handle engagements/meetings with internal and external parties and provide opinions on prosecution matters.
  • Able to execute administrative and strategic management duties.
  • Pleasant personality with good communication and interpersonal skills.
  • High level of integrity and professionalism.
  • Able to work independently, yet possess a strong teamwork spirit.
  • Analytical, organized, and capable of handling multiple tasks simultaneously.
  • Responsible and accountable for all assigned tasks.
  • Able to complete all instructions/assignments/tasks within stipulated time.

This is a permanent position located in Cyberjaya.
