HCUK Compliance Manager

Background: Hyundai Capital Services UK Ltd (HCUK) is a joint venture company established by Santander Consumer UK (SCUK) and Hyundai Capital Services Korea in 2012. It operates under the Hyundai Finance, Kia Finance and Genesis Finance brands, providing funding solutions for both Retailers and Consumers.

Job Purpose: Reporting to the Legal & Compliance Director, the Compliance Manager is responsible for ensuring that the organisation complies with all relevant compliance and legal standards, together with HCUK’s internal policies. This is an FCA certified role, accountable for enforcing regulations across HCUK’s business activities at all levels and providing guidance on a wide variety of compliance matters. The Compliance Manager will manage two Compliance Officers and will be responsible for developing a compliance programme and delivering it with the support of the Compliance Officers.

WHAT YOU’LL BE DOING

Key Accountabilities

  1. General Strategic
    • Influence corporate culture and strive to deliver impeccable standards of conduct across the organisation.
    • Ensure compliance with relevant regulatory requirements and build open and transparent relationships with all regulatory bodies.
    • Assist Legal & Compliance Director with development of the Compliance Monitoring Framework and annual plan. Manage / deliver the plan in line with prescribed timings, with support of Compliance Officers.
    • Oversee Financial Crime processes, providing support as required.
  2. Regulatory Requirements
    • Monitor and review new regulatory proposals and emerging regulatory risks. Discuss and agree how changes to be dealt with, including impact on business and changes required to process and procedures.
    • Prepare and deliver briefings / training as required, including providing updates at the Compliance Review Board (CRB) meetings.
    • Represent HCUK on industry or regulatory forums, to discuss developments and gain insight to inform of the company’s activity.
    • Ensure HCUK remains compliant with the FCA’s Senior Manager and Certification Regime.
  3. Compliance Standards
    • Develop, update, introduce and embed compliance policies and procedures and support the business to implement.
    • Undertake compliance audits and risk assessment, provide feedback, make recommendations for improvements and oversee their delivery.
    • Develop and assist on projects by creating strategies and guidelines to ensure new products are brought to market compliantly.
    • Update Compliance Review Dashboard with compliance elements.
  4. External Relationship Management
    • Develop strong relationships with all relevant regulatory bodies and key external stakeholders and coordinate activities with them and HCUK.
    • Resolve any queries raised regarding third party supply contracts.
    • Assist the Legal & Compliance Director with any interaction with the ICO relating to processing of personal data, whilst ensuring Privacy Advocates are aware of any developments.
    • Work with HCS to ensure their assessments are completed on schedule, including but not limited to Global Governance Programme (GGP) and Global Operations Compliance Assessment (GOCA) agenda items.
    • Build effective relationship with the SCUK Legal & Compliance department.
  5. Internal Relationship Management
    • Build relationships with internal stakeholders, to ensure adherence to legal and compliance obligations and regulatory requirements.
    • Act and deliver expert regulatory advice in relation to the laws and regulations governing consumer credit and HCUK’s products and services.
    • Support the Legal & Compliance Director where required and present any information on their behalf in their absence.
  6. Committee
    • Attend committee meetings including the Conduct Risk Committee (CORC), Operational Risk Committee (ORC) and Operational Review Meeting.
    • Assist the Legal & Compliance Director in the monthly presentation of the Compliance Review Board, write minutes, and chase any necessary actions that arise.
  7. Risk Assessment & Performance Improvement
    • Proactively identify compliance and regulatory risks, escalating these as necessary to the Legal & Compliance Director and other stakeholders.
    • Manage and close regulatory gaps and manage actions to address issues in line with dates agreed with FCA.
    • Be aware of the risk frameworks, and the nature of processing operations involving personal data across the business.
    • Work alongside the Enterprise Risk Team to ensure any compliance risks are documented and followed up where necessary.
  8. Management Reporting & Analysis
    • Report on the CRB Compliance framework through ad hoc interactions and at the monthly Compliance Review Board meeting.
    • Raise any areas of concern of incidents to the relevant departments / SMT, whilst monitoring their outcomes.
  9. Data Protection
    • Support delivery of the data protection framework to ensure ongoing compliance of all activities. Report concerns to the Legal & Compliance Director (DPO).
    • Review and approve Data Privacy Impact Assessments and present them to the business via CRB meetings.
    • Contribute to the development and maintenance of all HCUK data protection policies, processes and procedures relating to personal data.
    • Manage the Records of Processing Activities system for HCUK, ensuring it captures all necessary items and is regularly updated.
  10. People Development
    • Set robust / SMART objectives for direct report(s) and effectively manage their performance.
    • Ensure direct report(s) are adequately trained and supported to carry out their role effectively.
    • Encourage learning and development and create opportunities for personal / professional development.
  11. Risk & Compliance
    • In line with HCUK’s risk and compliance statement of responsibility and objectives, identify and assess risks, incidents and breaches.
    • Identify opportunities and provide suggestions within area of influence and promote awareness across your team.
    • Ensure related actions are progressed within agreed timescales.

Key Expertise

  • Experience of working within FCA regulated firm
  • Developing and implementing compliance programs
  • Leading multiple compliance audits
  • Strong communicator/ evidence of effective management of stakeholders
  • Has a sound understanding of risk controls, processes, measures and related MI/reporting and the related technical knowledge.
  • Has an appreciation of legal, regulatory and compliance issues relating to the use of customer data and is familiar with the principles captured around Consumer Duty and Conduct Risk.
  • A qualification in law/ finance or Compliance (e.g. ICA Certifications or degree) preferred
  • A good understanding of the motor finance market preferred

Other information

  • HCUK employees are currently hybrid working [mixture of home/ office]. HCUK’s head office is in Reigate, Surrey. A minimum of two office days per week is required.
  • This position may require domestic travel from time to time

  • Competitive annual basic salary, range £56,000 - £66,000
