Job description

Role Profile: This is a telecoms and technology role focusing on commercial and strategic legal and regulatory matters across a group of businesses.

Key Responsibilities:

  1. Advising business stakeholders across all departments on legal and commercial risk and proposing commercially focused solutions to ensure any potential legal/contractual risks are identified and mitigated.
  2. Reviewing, drafting and negotiating a wide range of commercial contracts including agreements relating to hardware, software licensing, services, IT support and end user license agreements.
  3. Reviewing, drafting and negotiating customer, supplier and consultancy agreements.
  4. Managing legal aspects of reseller arrangements and managed service contracts.
  5. Drafting and advising on data centre contracts and cloud service contracts.
  6. Working closely with product and sales teams to draft and negotiate contracts for business products and services.
  7. Managing contractual processes from RFP to implementation.
  8. Advising the businesses in respect of any disputes brought by or against any of the companies and managing litigation where required.
  9. Reviewing and drafting telecommunications agreements such as interconnect agreements, wholesale agreements and roaming agreements.
  10. Managing, reviewing and updating standard legal documents and agreements including terms and conditions and master services agreements.
  11. Advising the businesses in respect of intellectual property issues.
  12. Advising on data protection issues for all group companies, including drafting data protection agreements, data protection compliant contracts, and more generally advising the group companies on business implications of GDPR and local equivalent laws.
  13. Supporting the group Data Protection Officer with data protection issues and queries to ensure compliance with data protection requirements across the group.
  14. Legal input to relevant regulatory issues including:
  15. Assistance with reviewing relevant legislative/licensing frameworks for licence negotiations and/or renewals.
  16. Assistance with reviewing relevant legislation and subsequent licensing obligations relating to telecom security requirements.
  17. Assistance with preparation and submission of regulatory papers, notifications, complaints, investigations and responses, where they require specific legal input.
  18. Assistance with resolving customer complaints against the business.
  19. Understand and comply with the Health and Safety responsibilities relevant to the role as defined in the Safety Policy.
  20. Work in accordance with the safety procedures and safe working policies.
  21. Undertake appropriate security awareness training covering information security, data protection, financial crime and comply with information security responsibilities.
  22. Due to the nature of this position, the postholder must hold a satisfactory Basic Police Disclosure.

Key Skills and Experience:

  1. Qualified lawyer in any of the United Kingdom, Guernsey, Jersey or the Isle of Man (or another jurisdiction of near equivalent basis, e.g., Ireland, other EU).
  2. A minimum of 6 years' post qualification experience (PQE).
  3. Experience in drafting and negotiating commercial contracts.

Highly Desirable:

  1. Post qualification in-house experience preferably in the telecoms or technology industries.
  2. Experience in dispute resolution/litigation.
  3. Experience of working within a regulated environment is preferred (not necessarily in telecoms, e.g., experience in other regulated industries such as financial services).
  4. Commercially focused and willing and able to work alone and progress projects with business and commercial input.
  5. Ability to effectively prioritise and manage expectations associated with the wide scope and scale of competing and diverse requirements of the businesses and departments.
  6. Ability to explain data protection requirements to non-specialists.
  7. Good communication skills with ability to explain impact of legal issues.
  8. Ability to engage proactively and effectively at all levels to ensure the delivery of commercial objectives.
  9. Attention to detail and accuracy.
  10. Able to solve problems with a commercial and pragmatic approach to meet the needs of the business within the appropriate legal and regulatory frameworks.
