Summary of the Adult Social Care Lawyer role:
Sellick Partnership is thrilled to be assisting Barnsley Council in their search for an Adult Social Care Lawyer to join their growing legal team. Barnsley Council is a double-award winning Council of the Year authority, and it couldn't be a more exciting time to be joining them.
Responsibilities of the Adult Social Care Lawyer:
- Making applications to the Court of Protection and High Court, including COP applications around issuing concerning deputyships, welfare and best interests, deprivation of liberty including s21a, judicial review, and inherent jurisdiction.
- Providing detailed, accurate advice on the Council's responsibilities under the Care Act 2014, Mental Capacity Act 2005, Health and Social Care Act 2008, Mental Health Act 1983, and associated Regulations and Statutory Guidance.
- Providing legal advice and support across a broad range of areas including ordinary residence, Data Protection and Freedom of Information, safeguarding, provider failure, section 117 aftercare, and 16-17-year-old Deprivation of Liberty cases.
- Advising Service Managers and Directors on Adult Social Care policy and procedures.
Experience required for the Adult Social Care Lawyer:
- Qualified Solicitor, Barrister, or Legal Executive.
- While it is not expected that candidates will have experience of all the areas mentioned, exposure to Court of Protection or Mental Health Act advice would be beneficial. Training and support can be provided to develop within the role.
