Our client, a global innovative tech firm in the Renewable Energy Solar PV sector with an impressive track record of delivering cutting-edge products and utility scale solutions for its expansive pan-European corporate client base, is seeking an experienced Commercial Contract Manager to join their European team.
With offices across Europe, this role is based in Paris.
Role Summary
As a qualified Contracts Manager, you will ensure that the portfolio of contracts in the business follows contract and claim management methodologies in accordance with internal standard operating procedures.
You will review commercial and technical tender terms and conditions, develop contract strategy based on internal policies, customer requirements, and the overall execution strategy taking into account risk, pricing, scope, and schedule. You will identify contract baseline and highlight areas of potential risk while ensuring timely and accurate execution of commercial aspects in the portfolio of contracts.
Detailed Responsibilities :
- Ensure the portfolio of contracts in the business follows contract and claim management methodologies in accordance with internal standard operating procedures.
- Review commercial and technical tender terms and conditions.
- Develop contract strategy based on internal policies, customer requirements, and the overall execution strategy taking into account risk, pricing, scope, and schedule.
- Identify contract baseline (including terms and conditions, specifications, drawings, estimate, proposal, schedule and other documents incorporated in the contract) and highlight areas of potential risk.
- Ensure timely and accurate execution of commercial aspects in the portfolio of contracts (i.e. payments, claims, variation orders, warranties, provisions, guarantees, etc.).
- Verify that all parties to the contract have fulfilled their contractual obligations and there are no responsibilities outstanding.
- Assess success of the contract and lessons learned for future contracting. Document and communicate to all appropriate parties any deficiencies found as part of the closeout process.
- Establish and implement standard change methodologies in the portfolio of contracts to identify changes and quantify the additional time and compensation due per the contract, define approval requirements and communicate changes to the customer.
- Enforce and defend contractual interests with customers and suppliers during the whole of a project life cycle, including monitoring and assessment of changes and deviations, as well as defending and enforcing claims.
- Partner with Legal to develop the negotiation strategy and support negotiations. Support Legal in handling formal dispute resolution, litigation, and arbitration. Notify and liaise with Legal to report major claims and keep Legal updated on any critical developments during project execution.
Your Experience
Education : Master’s degree in Business Administration, Economics or Law.
Industry : Construction / Renewable Energy
Experience :
- Commercial experience in Contract Management and Subcontract Management functions (with emphasis on civil and electrical installations)
- History of contract drafting and supporting the supply chain in the appropriate compilation and flow down of terms for Subcontract formation.
- Processes and management/administration of varying sizes and types of contractual agreements.
- Solid background in change management, claim management, and contract-related legal issues and the possible effects in the relevant areas of responsibility regarding proposal stage and/or project execution and close-out.
- Working knowledge/hands-on experience of contracts executed under common law jurisdictions.
- Extensive experience in administering standard form Contracts.
- Member of Fédération internationale des ingénieurs-conseils (FIDIC) (Ideally)
Spoken Languages : Native French and fluent English
Open to Travel : Available for client onsite meetings (in the country) and business trips.
