Job Description:

Working with and reporting to the Supervisor, Environmental Monitoring & Protection, the Senior Environmental Bylaw Officer will co-ordinate and direct By-law compliance and inspection staff in administering and enforcing Acts and Sewers and Water Supply Bylaws.

Major Responsibilities:

  • Coordinates and directs By-law staff in required daily inspections, sampling work and any investigations for prosecution at various locations throughout the City.
  • Provides daily guidance to By-law Officers in the Environment Monitoring & Protection Unit.
  • Provides research and background for By-law infractions and escalates to prosecution through Ontario courts.
  • Reviews and checks prosecution files and submits to supervisor.
  • Checks the quality of staff sampling and quality control of inspection reports according to the Unit’s procedures and practices to ensure consistent sampling and inspections.
  • Provides By-law and enforcement expertise to staff.
  • Interprets By-laws and determines normal and unique courses of action to be taken to resolve.
  • Trains new staff on sampling, works management system, inspections and understanding the Units Practices and Procedures.
  • Represents the Environment Monitoring and Protection Unit at meetings with the public, divisions, elected officials and other groups.
  • Recommends steps to be taken regarding legal proceedings including laying charges and directing By-law Officers in the issuance of charges. Selects and compiles information for prosecution and forwards to legal staff.
  • Coordinates and directs By-law compliance and inspection staff in investigations regarding processing of environmental infractions and applications for permits, surcharge agreements and other documentation respecting the use of City sanitary or combined sewers by way of assignment, (i.e. review, follow-up of log sheets and field inspection reports) and final review to ensure resolution, with recourse to court action.
  • Responds to complaints by the public, police, division officials and members of City council.
  • Reviews inspection reports and on-line systems and conducts field inspections to ensure that inspections are conducted in compliance with the By-laws. Coordinates reports, sketches, photographs emanating from field inspections Officers, checking completeness, accuracy and determines follow-up. Prepares correspondence and reports.
  • Coordinates with Operations staff regarding spill response and tracing, as per the Sewage Works and Surface Water Spill Contingency Plan.
  • Coordinates issuance of notices or charges regarding environmental compliance matters within Municipal affected By-law jurisdiction. Liaises with Provincial Officials when needed on Environmental Monitoring & Protection files.
  • Reviews inspector’s reports and conducts field environmental monitoring inspections, in connection with applications for uses of City sewers and watercourses.
  • Reviews industrial responses to written notices of violations for appropriateness or further follow up action.
  • Ensures that costs incurred by the City to repair the environmental damage and By-law infractions are recovered.
  • Directs investigation of By-Law Officers. Provides reports on conditions found and action taken, for use by the Legal Division.
  • Designs surveys and co-ordinates poster/brochure programs to educate the public and private company owners to requirements and applications of sewer use By-laws.
  • Arranges issuance of Stop Work Order & Order to Comply Notice and ensures written confirmation is delivered.
  • Acts as Municipal Offences Officer regarding environmental compliance offenses and summonses in accordance with the Municipal Code and attends court to present evidence, as required.
  • Conducts and co-ordinates the training of staff for inspection and By-law enforcement duties.
  • Makes recommendations to revise procedures and implementation of same

Key Qualifications:

Your application must describe your qualifications as they relate to:

  • Secondary school graduation diploma or an equivalent combination of education, experience and training.
  • Considerable experience in industrial waste control and industrial processes.
  • Considerable experience working in an enforcement/compliance role.
  • Experience in interpreting and applying by-laws, conducting inspections, samples and chain of custody and investigations and taking progressive by-law enforcement steps to ensure compliance and issuance of Part IIIs and related documents.
  • Considerable experience in wastewater sampling techniques and use of various sampling devices and equipment.
  • Possession of a valid Ontario Driver's License Class "G

You Must Also Have:

  • Extensive knowledge and understanding of the by-laws and related legislation governing the various uses of environmental By-laws on public and private property within City limits.
  • Knowledge of desktop computers and software applications such as Microsoft Office and works management systems.
  • Ability to evaluate company responses to non-compliance.
  • Ability to co-ordinate, direct and review the work of by-law enforcement / inspection staff.
  • Ability to develop and review projects and co-ordinate the compliance and enforcement of numerous complex and/or complicated industrial operations at any given time and meet deadlines.
  • Ability to chair meetings with industry, provincial officials, community groups, elected officials and other Divisions, and to represent the Division at other meetings.
  • Ability to plan, prioritize, organize and work with minimal supervision.
  • Ability to conduct best practices review and make recommendations to continuously improve work practices and/or processes.
  • Ability to read and interpret plans, prepare sketches and field reports.
  • Ability to provide work direction to others and work independently.
  • Excellent analytical, problem solving and conflict management skills when dealing with staff, the public and/or contractors.
  • Highly developed interpersonal skills with the ability to interact with staff, conduct training seminars, build teams and communicate effectively at all levels of the organization.
  • Ability to work extended hours and/or staggered hours when required.
  • Familiarity with government legislation such as the Occupational Health and Safety Act, Ontario Water Resources Act, Environmental Protection Act, and Safe Drinking Water Act.
