Primary Responsibilities:
Under the direction of the Assistant Director, Representation Section, the Grievance Analyst is responsible for:
- Analyzing cases unresolved at the final level of the grievance process, with a view to recommending to the Coordinator whether to proceed to adjudication or arbitration and, if so, recommending whether mediation or expedited adjudication are warranted;
- Providing reasons / rationales to support any recommendation made to the Coordinator for referral or non-referrals;
- Drafting written submissions and replies to various Boards in the context of unfair labour practice complaints, duty of fair representation complaints and bad faith bargaining complaints, among others;
- Providing advice, guidance and assistance in the preparation and presentation of grievances and the gathering of related evidence;
- Providing advice and guidance to Components and PSAC officers and members in the interpretation and application of various collective agreements, Federal and Provincial labour and human rights legislation and the associated regulations;
- Assisting in the preparation of training and development courses and participating in or conducting grievance and adjudication seminars, workshops or formal courses;
- Preparing articles or bulletins on grievances and alternate dispute resolution methods for the information and education of Components, Regional Offices, PSAC officers and the membership;
- Reviewing proposed alternate dispute resolution methods and providing advice and guidance to the Components or PSAC on necessary changes;
- Providing interpretations of the collective agreement to PSAC Officers, Components etc.;
- Creating and updating subject files and jurisprudence indexes, as well as indexes of various third party decisions;
- Performing other Branch functions as required and as directed by the Coordinator.
What you will bring to the table:
Knowledge
- Knowledge and experience in the field of labour relations with progressive responsibility in the application of labour law in the interpreting of collective agreements and legal texts.
- Knowledge of acts and regulations, policies and practices which govern the employer-employee relationship.
- A thorough knowledge and understanding of the practices and principles of the labour movement, including arbitral jurisprudence, job content and classification principles, and human rights principles.
Abilities
- The ability to research case law, interview witnesses from various backgrounds and the ability to impart to others the meaning and effect of the language and construction of statutes, regulations and collective agreements.
- The ability to plan, organize and coordinate the preparation of various cases in a dynamic and changing work environment that requires critical analytical and logical thinking to provide solutions to problems.
- The ability to innovate and take the initiative in the process of grievance resolution.
- The ability to communicate orally and in writing at a high level.
- The ability to work independently with a minimum of supervision.
- The ability to understand, influence and serve the membership of a union and an understanding and commitment to trade union and equity principles and social activism.
What you need to know:
- Second language skills as per the Common European Framework of Reference for Languages (CEFR) level indicated above. Federal Government valid SLE results can be used toward this. Preferred candidates may have their second language skills assessed as part of the hiring process.
- Experience and formal training combined with demonstrated performance and ability may substitute for stipulated academic requirements.
