Role Description:
Contract Management services, inclusive of (i) drafting and negotiating Contracts/Sub-Contracts/Consultancy Agreements/LOAs/LOIs and other contractual instruments including collateral warranties, bank guarantees, parent company guarantees, etc., (ii) assisting the Contracts Manager in preparing and responding to other parties’ claims [EoT, Prolongation, Abortive Works, Acceleration, etc.], (iii) assisting the Contracts Manager in preparing against and defending to other parties’ formal disputes (litigation/arbitration) by preparing Statement of Claims, memorandums, etc. to serve the company’s interest, (iv) conducting risk analysis while acquiring lands or awarding contracts to contractors, and (v) drafting contractual correspondences.
Responsibilities:
Contract Management:
- Adhering to the organization’s Standard Operating Procedures and ensuring compliance;
- Drafting and negotiating Contracts/Sub-Contracts/Consultancy Agreements/LOAs/LOIs;
- Drafting other contractual instruments including collateral warranties, bank guarantees, parent company guarantees, etc.;
- Assisting the Contracts Manager in preparing against and defending to other parties’ formal disputes (litigation/arbitration) by preparing Statement of Claims, memorandums, etc. to serve the company’s interest;
- Conducting risk analysis while acquiring lands or awarding contracts to contractors;
- Drafting, reviewing, and responding to contractual correspondences in coordination with Project Managers and other stakeholders;
- Evaluating and defending the claims [Extension of Time, Disruption, Acceleration, Abortive Works] raised by Contractors/Sub-Contractors;
- Advising on complex contractual matters (inclusive of suspension and termination scenarios) by proposing best suitable solutions to avoid/mitigate/transfer risks and protect the organization from such risks;
- Being well-versed with FIDIC and other types of contracts and capable of drafting contracts and other contractual instruments.
Document Management and Maintaining Contemporary Records:
- Establishing, managing, and enforcing a document management process to control and monitor all contracts, sub-contracts, correspondences, claims, counterclaims, etc. on the central server;
- Conducting bi-weekly meetings/workshops with the Contracts Manager to track the status of pending tasks;
Educational Qualifications:
B. Tech or B.E. in Mechanical Engineering;
Experience: Min 12 to 18 years
Industries Acceptable From:
Construction experience in Real Estate, High Rise Towers, and Infrastructure.
Role Specific Qualifications & Training:
International Certification [MRICS, MCIArb, Law] is an added advantage; FIDIC knowledge and experience are a must.
